CUSTOM ORDER

Warning

APT AND ITS EMPLOYEES ARE NOT QUALIFIED TO APPROVE, RECOMMEND, OR ADVISE AS TO THE SUITABILITY OF APT PRODUCTS FOR ALL POSSIBLE USES OR APPLICATIONS. YOU SHOULD CONSULT THE LOCAL BUILDING CODE AUTHORITY OR FIRE MARSHAL’S OFFICE ON THE SAFETY AND SUITABILITY OF ANY APT PRODUCT FOR A PROPOSED USE.

Claims and Remedies

A claim under this warranty must be reported in writing, with proof of purchase, to APT, within thirty (30) days of the date that the defect is first discovered or reasonably could have been discovered. APT will then have a reasonable time to inspect or, at APT option, to have the product shipped at the owner’s expense, prepaid, to APT for examination of the alleged defect. APT shall be the sole judge of whether the product is defective and whether the defect is due to manufacturing.

Changes or Cancellations:

Orders entered and recognized cannot be changed or canceled. Because APT works with orders for personalized products by the client, for this reason they cannot be canceled and the deposit will not be refunded.

Custom Powder Coat Finish Requirements:

APT assumes no responsibility for wear, fading, discoloration or any other defects in the performance of customer’s custom powder coat specifications. The lead time and pricing may vary depending on the availability of paint powder.

Delivery of Freight & Damage:

APT reserves the right to use its own or commercial carriers for the “best way” to ship the products, at its sole and absolute discretion. When redelivery of merchandise is required because customer is not ready to accept merchandise, the order may incur storage fees and additional charges of as much as 5% of the value of the order. Title to merchandise shall pass to the buyer upon delivery by APT.

All products are packed to comply with standard carrier requirements. The consignee should carefully inspect all shipments before acceptance and the delivering carrier should be instructed to record any damage or shortage prior to signature. If further damage is found after delivery, immediate inspection by the delivering carrier should be requested. Notification of concealed damages must be made to the delivering carrier within seven (7) days after delivery of merchandise. Carrier liability ceases after seven (7) days after delivery.

CAUTION:

After obtaining a clear receipt for shipment, the delivering carrier is no longer responsible for damage or shortages. APT will not be held responsible for damage claims not due to freight.

RETURNS:

APT will not permit the return of any products or materials without written consent once the products and/or materials are shipped as acknowledged. All returns require an APT assigned Return Number prior to accepting the return.

APT ALUMINUM STRUCTURES LIMITED WARRANTY

APT provides the following limited material warranty for Pergola Systems, subject to the conditions and limitations listed herein, APT warrants Pergola Extruded aluminum products and panels to be free from material defects in workmanship and materials. This limited warranty covers workmanship and materials for 20 years from the date of installation. This limited warranty is void if the warranted good moved from the location listed on the warranty certificate and covers only normal and proper use. This limited warranty does not cover damage caused by misuse.

This warranty extends only to the original purchaser and is nontransferable. This warranty does not cover the cost of installing any product, the cost of removing or disposing of any product, or the cost of installing any replacement product furnished under the terms of the warranty. APT does not warrant or guarantee that any aluminum parts provided under this limited warranty will match the originals in color or pattern. APT reserves the right to discontinue or modify any product line or color without notifying the original purchaser. If the original product is not available, we retain the right to choose to provide replacement material of equal value or quality.

The lifetime coverage of this warranty only covers products used on residential or commercial property where the owner resides, during the owner’s lifetime. The warranty period for products installed on property that is not residential property where the owner resides, including but not limited to schools, condominiums, apartment buildings, and rental property – or on property owned by other owners including but not limited to corporations, government agencies, partnerships, trusts, religious organizations, and cooperatives will be twenty (20) years following the installation of the aluminum products and is limited to the original owner (non-transferable).

Exclusions

APT will not be liable and this warranty does not apply to any failure, defect, damage or expense resulting from or related to the following:

Installation or handling of products after they leave our facilities. This includes any misuse by the contractor or other installer.
Abnormal use of the products.
Heat or radiation.
The use of any product not manufactured by us: Labor, transportation, or installation costs; color changes due to weathering or aging if the color change is uniform and the same when exposed to the same or similar sunlight and other environmental conditions because weathering will cause any colored surface to lighten, darken, grow or accumulate, dirt or gradually spotting of these conditions depends on air quality, the property's geographic location, and other local conditions over which APT has no control.
Other factors not controllable by APT, weathering, rust, mold, building settlement, structure failure (including foundation and walls), use of incompatible fixtures, fire, flood, lightning, ice, wind. objects, earthquake, hurricane, sun, cyclone, gale, tornado, weather of a catastrophic nature, acts of God, intentional acts, unreasonable use, misuse, physical abuse, vandalism, riot, insurrection or civil disorder, accidents or corrosive atmospheres (such as contaminated by acid rain, harmful chemicals or vapors) or other defects not caused by APT; or
Ordinary wear and tear.
